TERMS OF SERVICE & LICENSE AGREEMENT

1. ACCEPTANCE OF TERMS

By accessing, browsing, or purchasing from RCA Home Studio, you agree to be bound by these Terms of Service and License Agreement.

If you do not agree, you must not use this website.

2. NATURE OF PLATFORM

RCA Home Studio is an online platform operated by RCA Lifestyle Ventures OPC that facilitates the sale of architectural house plans created by independent licensed architects (“Authors”).

RCA Lifestyle Ventures OPC is not the author of the architectural plans
RCA Lifestyle Ventures OPC acts solely as a commercial distributor and agent
All intellectual property rights remain with the respective Architect

3. ARCHITECT-BASED LICENSE GRANT

Each architectural plan is the intellectual property of its respective Architect (Author of the Design).

Upon purchase:

The Architect grants the buyer a non-exclusive, non-transferable, single-use license to construct ONE (1) residential unit only based on the purchased design.

This license is:

Personal to the buyer
Limited to a single construction project
Non-transferable and non-sublicensable

RCA Lifestyle Ventures OPC facilitates this transaction but does not independently grant the license.

4. STRICT USE RESTRICTIONS

You expressly agree NOT to:

Use the plan for multiple constructions
Resell, distribute, or share the plans
Upload the plans online or to third-party platforms
Reproduce the design for commercial developments
Claim authorship or ownership of the design

Any violation shall constitute intellectual property infringement and may result in:

Legal action
Claims for damages
Injunctive relief

5. NO AUTOMATIC BUILD AUTHORIZATION

Purchase of a plan DOES NOT include:

Signed and sealed architectural drawings
Structural or engineering plans
Building permit approval
Compliance with local codes, zoning laws, or site conditions

To legally construct, the buyer must:

Engage a licensed architect and engineers
Secure signed and sealed plans
Obtain all required permits

6. OPTIONAL PROFESSIONAL SERVICES

Additional services such as:

Signed & sealed drawings
Design revisions
Construction services

may be offered separately, including by RCA Build Pro Construction OPC.

These services are governed by separate contracts and are not included in the purchase of the plan.

7. SIGNED & SEALED DRAWINGS (CLARIFICATION OF SCOPE)

Signed and sealed drawings, when availed as a separate service, shall indicate that a duly licensed professional has reviewed and approved the plans for compliance with applicable regulations.

Such approval generally covers:

Applicable building codes, laws, and local regulations
Zoning and setback requirements, as applicable
Structural considerations, subject to engineering design and validation
Adaptation of the design to the specific project site, based on available information

All approvals are based on information provided by the client and may require further verification through site inspection, surveys, and engineering analysis.

However, such approval does not constitute a guarantee that:

All site conditions (including soil, utilities, or environmental factors) have been fully verified
All regulatory approvals will be granted without further revisions
The design is free from the need for additional coordination with other professionals

Final responsibility for construction, site investigation, and regulatory compliance remains with the:

Project owner
Engaged licensed professionals
Contractors and consultants involved in the project

8. PROFESSIONAL & TECHNICAL DISCLAIMER

Neither the Architect nor RCA Lifestyle Ventures OPC guarantees that the plans are suitable for:

Specific site conditions (soil, orientation, climate, utilities)
Local building regulations or zoning laws
Structural requirements without engineering validation

All final responsibility for implementation lies with:

The Buyer
The hired licensed professionals

9. LIMITATION OF LIABILITY

To the fullest extent permitted by law:

RCA Lifestyle Ventures OPC shall not be liable for any direct, indirect, incidental, or consequential damages
Liability, if any, shall be limited to the amount paid for the plan

RCA Lifestyle Ventures OPC shall not be liable for:

Construction errors
Structural failures
Misuse or unauthorized modifications of the plans

10. INTELLECTUAL PROPERTY

All architectural designs remain the exclusive property of the respective Architect.

Unauthorized use, duplication, or distribution constitutes:

Copyright infringement
Breach of contract

and will be subject to legal enforcement.

11. DIGITAL PRODUCT POLICY (NO REFUNDS)

Due to the nature of digital products:

All sales are final and non-refundable
No returns or exchanges once files are delivered

Exceptions may apply only in cases of:

Duplicate payment
Proven technical delivery failure

12. LICENSE CERTIFICATE

Upon purchase, a License Certificate may be issued identifying:

Buyer name
Plan purchased
Architect (Author)
License scope (single-use only)

This document serves as supporting evidence of the granted license.

13. ARCHITECT RELATIONSHIP

Architects offering plans on this platform are independent professionals.

RCA Lifestyle Ventures OPC:

Does not assume professional liability on behalf of the Architect
Does not guarantee the performance of the Architect
Acts solely as a marketplace facilitator

14. DATA & COMMUNICATION

By making a purchase, you agree that your information may be shared with the Architect only as necessary to fulfill the license and any requested services.

15. GOVERNING LAW

These Terms shall be governed by the laws of the Republic of the Philippines.

Any disputes shall be resolved in the appropriate courts of jurisdiction.

16. AMENDMENTS

We reserve the right to update or modify these Terms at any time.

Continued use of the website constitutes acceptance of any changes.
